This article is interesting considering that Dave Matthews was Syncrude's bird and ecology team leader. Dave Matthews has since died of Cancer. Matthews, who had no training in wildlife management, since his only previous Syncrude qualifications was expertise as a Heavy Equipment Operator.
It came out in the court hearings that Dave Matthews has since died of Cancer. Interesting? Yes, could it be as result of working in close proximity to the Toxic Tailing Pond?
Did Equipment Operator/Migratory Bird Specialist Dave Matthews qualify for Workers Compensation Alberta death benefits, since there is about a 99% Probability Mr. Matthews expired as a result of working in such close proximity to the Tailing Pond/s.
I am simply curious as to whether or not Dead Syncrude Personnel qualify for this benefit, considering it equals of probably exceeds the Test for Cancers caused as a result of prolonged Occupational Exposure to extreme known Carcinogenic Toxin Lakes. There is no Scientist in the World that would contest the Extreme Toxicity & Cancer causing known Toxins in these Poisonous Chemical Lakes.

Why does Canadian Law Discriminate Against Injured Workers

During this trip down the road of legal redemption I have ran across a whole cross section of interesting humans. A good deal of injured workers some active, some just fed up fighting a system that is so heavily stacked in favor against them. It truly is a daunting beast to go up against. It has been said that a man that has been stripped of everything, is the most dangerous man in the world. Because in his mind he simply does not have anything to loose. It struck me yesterday in one of my trips down the road of discovery that every single side road that the WCB sends you down ends up being a dead end. When every single avenue of legal and administrative, medical road you turn down ends up a dead end it tears at the very fabric that you once thought was a working part of our society. After so many friends, and other injured workers I have met revealed that they where completely screwed over by the bogus WCB IME exams and ended up with nothing or on welfare for life, I don't live that dream anymore. I was on the misguided belief that once that was conducted, then I would at least have a ELP and a NELP pension to live on. I had dreamed that then if there was any money whatsoever from a genuine IME, and not some play acting charade conducted by a felonious hired doctor with malicious intent, that I could apply those monies to going to the Mayo Clinic to have my injuries treated. I now know that that dream will NEVER happen. Across the board government corruption is spilled across our airwaves every day, and every day nothing is done about it. Firing flunkies, and not the man in charge of flunkies is not dealing with corruption. Not showing true transparency and not revealing the true flaws in the system and working on correcting those corrupt mechanisms, does not show true leadership.
Keep in mind, I walk through multiple mine fields the two most dangerous of which are the WCB Alberta minefield, and the AHS minefield. You could die waiting for treatment from either of these agencies, because they are both trying to fix you for under ten bucks.
Then creating even more secretive mechanisms, amendments to (FOIP) to hide cronyism, corruption and bungling is not the "Spirit to Achieve". That is giving corrupt bureaucracies even more powerful tools and mechanisms to DECEIVE, that is not an achievement in my books. I originally thought that some sort of political solution could be arrived at in my situation. I now know that is another dead end. The politicians in charge are too busy with their own greed agenda, and creating even more bureaucracy and more layers of insulation to cover up their bungling, and ineptitude. This party can't be called the Tory party anymore, it has become the GORY party. Because everything they touch becomes a horribly messy Gory Hackjob, complete with Hackmen, Hatchetmen, and of course the obligatory Bagmen. Why do we not have a Honest Leadership and Open Government Act. So a political solution to my situation is now 100% impossible with these bunglers in charge.

I was stunned when I heard Hector Goudreau say there was no need for a overhaul of the WCB Alberta. How can these elected officials stand up and say they represent our citizens? We don't all dream of having a Upgrader built in our back yard, I'm not mentioning any names here. The worlds most powerful economy is shifting gears on how it produces and consumes energy, it is focusing on new technologies. The new American Administration is focusing on new ideas, they don't want their landscape carpeted with SO2 flares. We can either be part of the solution, or be left behind. Having our politicians go to the US and brag about how frigging great we are is not what they want to hear. They want to here how we are going to help our largest trading partner get out of this economic jamb, and pave a new future. Harper and Ed just don't get it. They try to claim that they created the economic climate during the boom. BS, We live in a energy/mineral based commodity economy and that is why we ride on these boom bust waves. They knew the bust was coming and lied to the population, and now they try to distance themselves from the outcome. Claiming, "how could we have known?" And, "this is worldwide, we didn't cause it." WE need real leaders, with real reform. If we do not get on board with reform, when we wake up on the day the Americans have completed theirs it will be too late. For us to support leaders who think they can do a end-run around American policy is just plain stupid. By the time they are done reforming their government policies and labor standards, if we have not, we are going to be in big trouble. Harper was bragging about the Mulroney Free Trade Agreement. This is Alberta and if the people in charge can not see the future coming, then those people need to be replaced. I believe that my remedy to my WCB situation is a Constitutional Challenge. Our rights as a group or as a individual injured worker have been stripped from us because we got hurt at work. We are being discriminated against by the act of denying us true legal remedial tort. Talk to any judge, he will tell you that is not a board made up off old bagmen. All other citizens, under all other circumstances may apply to the courts for tort remedy, except us. All we want is too stand in front of a real judge(s), not a tea club of old crony bagman from the WCB. When the Charter was signed there existed on the books laws that are contrary to the Charter. The WCB acts in All provinces are in violation of the Charter. You cannot strip us of the right to seek true legal remedy, the charter guarantees it. To have laws on the books that discriminate and strip individuals or groups of rights guaranteed under the Charter, is in direct conflict with the Charter of Rights and Freedoms. We are all protected equally under the Law.

The validity of the Workers Compensation Act should be challenged on the basis that it infringes the equality rights guaranteed in section 15(1) of the Canadian Charter of Rights and Freedoms (“the Charter”).
In particular to be specific Section 17 is discriminatory, and as such unconstitutional:

(3) The Board has authority to reconsider any matter that it has dealt with and to rescind or amend any decision or order previously made by it.

(5) The Board has the same powers as the Court of Queen’s Bench for compelling the attendance of witnesses and of examining them under oath and compelling the production and inspection of books, papers, documents and things.

(6) The Board may cause depositions of witnesses residing in or outside Alberta to be taken before any person appointed by the Board in a manner similar to that prescribed by the Alberta Rules of Court.

As I watch developing news on the H1N1 Flu Pandemic, it strikes me how this government has turned a simple public health issue into a boondoggle. At the core of this issue is basic health care needs of human beings, and in particular those persons who are the most in need of that treatment. As injured workers we are used to this style of delivery of medical treatment. I don't think people of Alberta need any more evidence, that Private style health care for Rich people is already here. Stand back now, trough feeders first! Oink Oink. Back of the line you! Trough feeders will even shove pregnant women out of the way. Got to love private pay for health care. Whoever is in charge, go to his house he has probably got lots. This is just ripe for a satirical cartoonist. The trough feeders out beside the barn inoculating each other, while telling the rest of the farm animals there is none left. Oink. Moo. This particular crisis is just a shining example of how the government just doesn't get it. They just can't listen to the needs of the people. They think it is all about them, and their pals. For seriously injured workers the primary need is to treat the medical needs of that individual. Proper medical attention is so critical to a seriously injured worker. I sure hope that the reason no investigation into gangster type organized crime at the WCB is because the RCMP are involved too. I mean don't you think it is kind of weird that politicians or government officials never get investigated here in this province? I sure hope not. For the sake of injured canadian workers. If so, we are all doomed. I was thinking today that this whole scenario would make a great premise for a video game. I mean the possibilities for different scenarios is infinite. These people have had their future stolen from them, not just from having to live their lives with disabilities left untreated, which can cause a whole litany of complications as a result. But from not having proper retraining, for occupations that will NOT result in further damage to their already broken bodies. Hostages because of the malicious attack unleashed on them by WCB Alberta, resulting in bankrupt families, families torn to pieces with the survivors left broke, depressed and stigmatized by our government. So as a result these victims are left to their own devices to fend off depression and suicidal tendencies. To be shut out of the opportunities we used to enjoy in society as fully functional, happy contributing members of society is a hell in itself. To be denied proper medical care, medications and medical treatment that could help ease some of our physical, mental suffering is heartbreaking to these victims. The claims managers at the WCB Alberta play mind games with us, torment us, and mock us. They know exactly how critical our medical treatments are to us. They use this to mentally torture us, they know exactly what the effect of denying us medical treatment will do to seriously injured workers. They do this to enrage us, resulting in seriously injured workers being banned from their premises. These people are trained in these tactics. As a result we are marginalized, labeled as crazy, stigmatized as "one of those crazy malinger injured workers". Some of these workers end up homeless as I did. A social worker and my friends advice helped pull me back from the precipice. So you are left completely bankrupt financially, mentally exhausted, and medically untreated injured worker staggering around wondering, "What the Hell went wrong?" To advocate such heinous deliberate willful malicious acts of social terrorism on your society will result in a society that is socially bankrupt. As a result we end up feeling trapped, abused, mentally tortured and not knowing whether or not our government will unleash even harsher penalties on us. We live in fear every day of the government cutting off whatever tiny little stipends that we receive. This government governs by "FEAR". I never used to be afraid of my government. But I am now. For what? Why? Because I got hurt at work? Good men and women are dying in Afghanistan, to protect democracy. You cannot hold up this organization (WCB) as a shining example of democracy, and how democracy treats its own citizens. It is funny how seemingly innocuous events are connected. George Bush visits Edmonton to speak to the Oil Elite, and to keep the corporate piracy dream alive. The Americans ran him out of town, and we throw him a party. George Bush fully represents the right wing agenda. The corporate piracy that his gang represents is responsible for the corporate gang rape of North America. George W Bush and his pals are responsible for the Global Melt Down. Right wing corporate greed and the worship of money is why the WCB corporate model is so tightly embraced by our Conservative Government here in Canada. The HMO's of America have highly honed this model until it is a true hybrid of the American Corporate Medical Machine. Fully engaging the corporate medical model of America, is what our Alberta Conservative Government is busy implementing right before our eyes. If you cannot see this, you may be living on Mars. The United States of America is busy trying to shake this model, not here, Tories embrace this model. Our government is starving for health dollars, no need to raise taxes or fees to fund it. Just run the system into the ground. When that is completed, roll out the American model. Touting it as the only available option that will save our health care system that the Conservatives are so intent on killing. All this while 900 Million Dollars is being spent on the new "Edmonton Clinic". Well once they have fully mashed the current system, and that of course will include crushing those pesky health care unions that all Tories hate. Then it will be time for their new and improved pay for services system, and with a new Super Board to ensure that those Goddamn poor people don't abuse the system and actually get proper health care. Then our governments true agenda will have been completed. All hail George Bush! Once again the true right wing agenda rears its ugly head. When you are relying on corporate health care, guess what? You're "Denied". When this is all done, the only people who will be able to access top notch medical care are the people who work for the top corporations. Like, Oil companies who pay for the absolute best health care "Supplemental Insurance" for their employees. That's who is going to be getting care at the new Edmonton Clinic. The reason this government has no money is because 3 of their contractor friends have to be paid 80 dollars in order for you to be delivered 30 dollars of anything. More corporation, less government. The Dream of Freedom

It has been weeks since I have updated my blog. I had hoped that since I had delivered a copy of the prescription my doctor wrote for my orthopedic bed, eventually something would happen. I left a message on Colleen Bamford's answering machine, that her message says she never checks. I believe it, a do nothing getting paid to do guess what? Nothing. Ain't nepotism great? Well at least someone related to a big Alberta construction firm is picking up a paycheque for doing absolutely nothing, except picking up bonuses for abusing seriously injured workers. Good job Colleen.
It is interesting in her last letter she quotes the writer as being unable to find any evidence. Well if you sit around all day doing nothing, your investigation will as a matter of course, turn up no new findings. Neither Collen Bamford, nor her new Hack doctor (Mr. Charleton) even attempted to do a thoroughly complete competent investigation for evidence of prior neck complaints. Once again the findings of any of the WCB so called investigations read like some sort of sick perverted Reform School itinerary. They twist the facts until they are all distorted, and really at that point they reach the prominence of outright lies. I have given this felonious insurance corporation every possible opportunity to help me, but they still refuse me even the pleasantry of a good night's sleep. And then as a final insult they tell me that the only way I am allowed to communicate with them is via written communiques. I've postulated the idea that the WCB offices across Canada and the US are rotating their KOOK doctors to avoid conviction of conspiracy. I can now see why they had to form a WCB Club to share felonious ideas. If this were not true then a responsible organization would reign in their loose cannons, or bar them.

I have heard absolutely nothing since I produced the evidence to my doctor and he agrees that the evidence that I hurt my neck when I fell is undeniable. The WCB refuses to respond in any way. Just one more trick in their never ending bag of tricks to deny legitimately injured workers any kind of help. Due process, in my eyes seems like an ideal that is a million miles away. Something as unreachable as freedom was for the slaves of America. I now know what it is to be persecuted in your own country, a true injustice has been committed here. I have waited over 3 years for a chance to be heard in a true court of law. I now realize that I will never have my day in court, that is a true Canadian fantasy. It is now clear that any sort of Kangaroo IME that the WCB Alberta would put together, would just be another complete farce. Complete with KOOK IME doctors, it would be a complete embarassment to the Alberta Health Sciences community. I don't dream of that phoney WCB act anymore.
Freedom is an illusion. Persecution by one human being who is more powerful than our government, law courts, our entire medical community is not a quality of democracy our Prime Minister should be bragging about. He sneers at China regarding human rights, look in your own back yard Stephen.
It is difficult most days to produce any new blog content because of the physical problems my neck is causing. The same goes for dealing with any of the dozens of letters I need to write to officials, looking down at documents actually sets off the "popping" of my neck. I am no different than any other human being on this planet. I was born with precisely the same number of nerve endings as any other human, I feel pain and fatigue just as any other human would. And, I was born with exactly the same amount of feelings, neurological and physical feelings as any other person. As a result I have been kept quite busy finalizing all of the paperwork required for the completion of my CPP, and the necessary paperwork for AISH.
To this day I am absolutely stunned as to exactly why I am being forced to apply for AISH. My medical and physical needs are in no way the responsibility of the Government(Taxpayers) of Alberta. The government cleverly forgets to mention this little fact that it is the taxpayers of Alberta, and the rest of Canada that are on the hook for the care of these permanently disabled persons. Why? The Meredith principle should be renamed the Canadian Dream. I will phone do nothing's supervisor Trevor Dill today. It is probably her cousin.

Candian Forces mission in Afghanishtan

Canada sends its brave young men and women overseas to protect our sacred values and beliefs. Brave young Men and Women are dying overseas to protect our human rights. Yet there are individuals and corporations that are allowed to operate outside of those values and laws that we hold so dear to our hearts. And it is high time that our federal government stood up and be counted. It is time they (fed gov.) pursue these white collar criminals that pervert our laws and values. They operate under the guise of legitimate insurance corporations. You would know them as the WCB. I am a Canadian. I come from a long line of Canadians, and I do not enjoy having my individual rights and freedoms stripped from me, simply because I was injured at work. The charter was not written for persons or corporations to simply "Opt out" at will. Our charter is universal in its application across this great land, and it is time that these criminals are brought to justice for their crimes against innocent citizens in our society.

As it turns out the WCB Kook doctor that they claim is their expert is in fact a family physician. His is in no way an expert, or in anyway qualified to make a rational determination of my spinal condition. As stated previously, the AMA Guide to permanent impairment is the clinical benchmark for determining my permanent disability. The WCB Alberta organization producing this person as a qualified specialist in this field is just one more act of malicious fraud perpetrated by their claims managers. They do this every day. It is nothing new for them. That is why the majority of their documentation is not even signed by them personally. It is so they can avoid prosecution. They produce documents with mechanical signatures. They willfully put the wrong date on documents or simply no date at all. Apparently they don't have access to Microsoft Word. When called upon to produce a response, they just wave around old documentation. This corporation has fraud written all over their faces. For any doctor to come to the conclusion that their is nothing wrong with my back is a blatantly fraudulent conclusion. Perhaps these WCB doctors should read their own guidlines on page 35, even though it is more than 10 years old. Yep this is Alberta alright, stuck in the last century.
Considering the fact that, that same doctor, Dr. E.D. Charleton works within the confines of the Millard Health Center, he knows full well that they never did order, nor complete my IME. He and their organization are fully cognizant of this fact. The also are completely aware that the only way my condition can be fully examined is by the completion of a proper IME according to the standards laid out in the AMA Guide to permanent impairment. Any other determination is a act of outright malicious fraud. These self professed specialists, and experts have full access to all of my medical information. The don't even bother to read their own guidlines.
For any medical professional to produce documents of this nature, considering the fact that they are claiming some sort of expertise in the Spinal Injury field of medicine is outright malicious defamatory fraud. These professionals are acting with deliberate malicious fraudulent intent. And they are acting willfully and with the full cognizant awareness that their false misrepresentations are malicious and fraudulent in nature. To claim that they have reviewed my case or all available documentation is 100% pure malicious fraud. These professionals and the corporation of the WCB Alberta are colluding in the production of malicious fraudulent documents.
Which is punishable by law.
By their continued determination that my current neck difficulties are not related to my fall backwards onto the frozen earth, is in itself evidence that they have not in any way, shape or form reviewed or investigated my evidence or claim. Their statements are false, malicious and outright lies, perpetrated by their own doctors and claims managers. There is clear cut evidence of a conspiracy to commit fraud.
It is no secret that the WCB gets there victims to sign a access to information consent form, so that they can share your medical information with doctors and other medical staff, who require it in order to perform their duties. They would hold this up as a legally binding agreement.
However this contract is null and void if one of the participants is acting with malicious and fraudulent intent (Alberta WCB). In any contract their is an unwritten understanding that the party you are signing an agreement with, will not act in an inappropriate malicious fraudulent manner against you. In this case, one of the contractual signatories is guilty of violation of that contract. That being the WCB Alberta. In agreeing to share my medical information, I would only sign into such a contract with the explicit understanding that; any or all of my medical information would only be share with medical professionals who are directly involved in my treatment. Or who are directly interested in assisting me in being medically treated. Why would I want to share my medical information with a Doctor for Hire, who's only vested interest is profiteering from my continued pain. He is not a expert, he is not a Spinal Surgeon. He is not a medical investigator, or he would have come to a different conclusion. His only interest in my medical case or any fool who would come into his gun sights is his own financial gain from producing negative and outright false reports on my condition. The WCB Alberta, the doctors who write these defamatory reports, and the claims managers are all guilty of violating my Access to Information rights.
I did not, do not, and never will consent to the sharing of my private medical information with medical professionals whose intentions are 100% clearly malicious in their intent, and execution. Once again the

WCB

has violated my rights.

In the United States of America there are clear cut laws to deal with these felons. They are the RICO Laws and they were created to stop just such activity. Time will tell if our federal government has any true "GUTS".

Alberta Appeals Commission

My worst fears have been realized regarding the Alberta WCB appeals commission
This is not a true legal dispute mechanism, it is a ultra cushy BS appointment of even more friends of the government. This is nepotism gone bezerk. Seriously injured Ironworkers with broken backs cannot even qualify for a bed, while the trough feeders continue to swell in number. I can guarantee you that they sleep on pocket coils. These people do not even feign concern, or interest in your plight.
Democracy died in Alberta, a very long time ago. The real shame in all of this, is the fact that almost no one showed up for the funeral. Elected officials running this province ended a long long time ago.
These people are making a mockery of Canada. It makes me sad to know that so many will suffer from the abuses of this government sponsored Super bureaucracy run amuck. The trough has been allowed to balloon to an unimaginable bloated and deformed size. The "demockery bureaucracy" has written their own laws(policies) for so long they actually believe that they are Law makers. They only need Law makers as figurehead puppets.
I thought that a true legal entity with a balanced representation would be a good solid place to consult on how to battle a corrupt and fraudulent corporation.
I really am only beginning to grasp what a completely naive and stupid idea that was. After a brief visit, their non action was obvious. I now know how naive I really am. The Office of the Appeals Commission as far as I am concerned is one more part of their farce. This is just one more layer of stupidity. This is a super corrupt organization whose chief mandate is defrauding seriously injured workers of any form of compensation.
Obviously a made in Alberta solution that was farmed out to an American consultant.

The response from the commission representative was typical in its merry-go-round approach to a solution. This entire situation never even needed to reach this point, if the dispute resolution process was an actual working mechanism. It's originators intentions have been grossly perverted by the demockery bureaucracy. In doing so they have created a squirrel cage that you simply cannot escape. The process is so mind numbingly drawn out that it is almost guaranteed to discourage even the most seasoned mangled human.
The Alberta WCB is just one big SHAM wow. Claims managers mindlessly grinding out more of their southern consultants well rehearsed BS.
This is not a problem that is unique to the the Alberta WCB, this is a giant "Corporate Culture" created and nurtured by our government. It is ridiculous in it's premise, and even more retarded in actual practice. Hello, did anyone notice how all this corporate BS backfired in the US? Albertans bought the Corporate Hallelujah stuff hook line and sinker.

Alberta WCB's intentions were clear from the beginning, cutting off a seriously injured Ironworker with a shattered vertebrae and steel bars in his back after only 6 months recovery. Why? Because I refused to be mocked, would not accept WCB Alberta's outright denial of my injuries, and refused to be threatened into signing legally binding documents. It is interesting given the fact that it is against the law in Alberta to threaten persons within the confines of a licensed medical facility in the Province of Alberta.
No need for these people to obey the Law, they will just create a new policy, and have their puppet Lawmakers rubber stamp it into law. Isn't corporatism a wonderful tool for non elected officials to completely strip Citizens of Canada of all of their individual rights and freedoms.

When a government can no longer hear the cries of it's citizens over the bitching and moaning of corporations, then they are no longer a government. This makes them a puppet regime. (See: America)

I filed an appeal, which the WCB never responded to and even though I have repeatedly brought this contentious item up, they refuse to discuss it. How can I have respect for a commission to which my appeal shall never arrive. Just one more BS arm of a very large BS organization. There is not one part of this government that impresses me. Any organization that maliciously pursues defrauding seriously injured workers out of benefits they are legally entitled to, only impresses ultra right wing corporate wing dings. Government BS does not impress me, any farmer will tell you BS ain't worth a hill of beans. Yet, this government doles out BS like it is a valuable commodity. The bureaucrats are doling out horse manure and telling us that it is caviar.
Someone has to put a stop to these lawless bastards, plain and simple.
Since their is no one in this government that is willing to help seriously injured workers. There is no other choice. It is them or us. Democracy is a community, not an idea. Hope may be our only salvation.

The Americans should use NAFTA to put a stop to unfair trading practices in Canada. The Alberta WCB does not help seriously injured workers and cheats all others out of proper compensation. I can't quite see the Meredith Principle from where I am standing. How could the WCB Alberta not have a giant surplus when they won't pay? Giving Alberta employers the lowest WCB rates in Canada.
