Why does Canadian Law Discriminate Against Injured Workers

During this trip down the road of legal redemption I have ran across a whole cross section of interesting humans. A good deal of injured workers some active, some just fed up fighting a system that is so heavily stacked in favor against them. It truly is a daunting beast to go up against. It has been said that a man that has been stripped of everything, is the most dangerous man in the world. Because in his mind he simply does not have anything to loose. It struck me yesterday in one of my trips down the road of discovery that every single side road that the WCB sends you down ends up being a dead end. When every single avenue of legal and administrative, medical road you turn down ends up a dead end it tears at the very fabric that you once thought was a working part of our society. I used to dream that if I where ever to get a IME, that it would be conducted properly. Video Link example.

The AMA Guidelines to Evaluation of Permanent Impairment, Vol. 4, pp3/98, indicates that a loss of vertebral motion segment integrity is a 20 percent impairment, without positive exam findings. The guidelines also indicate that pain with a loss of function is reason for impairment (Chapter 15).

After so many friends, and other injured workers I have met revealed that they where completely screwed over by the bogus WCB IME exams and ended up with nothing or on welfare for life, I don't live that dream anymore. I was on the misguided belief that once that was conducted, then I would at least have a ELP and a NELP pension to live on. I had dreamed that then if there was any money whatsoever from a genuine IME, and not some play acting charade conducted by a felonious hired doctor with malicious intent, that I could apply those monies to going to the Mayo Clinic to have my injuries treated. I now know that that dream will NEVER happen. Across the board government corruption is spilled across our airwaves every day, and every day nothing is done about it. Firing flunkies, and not the man in charge of flunkies is not dealing with corruption. Not showing true transparency and not revealing the true flaws in the system and working on correcting those corrupt mechanisms, does not show true leadership.
Keep in mind, I walk through multiple mine fields the two most dangerous of which are the WCB Alberta minefield, and the AHS minefield. You could die waiting for treatment from either of these agencies, because they are both trying to fix you for under ten bucks.
Then creating even more secretive mechanisms, amendments to (FOIP) to hide cronyism, corruption and bungling is not the "Spirit to Achieve". That is giving corrupt bureaucracies even more powerful tools and mechanisms to DECEIVE, that is not an achievement in my books. I originally thought that some sort of political solution could be arrived at in my situation. I now know that is another dead end. The politicians in charge are too busy with their own greed agenda, and creating even more bureaucracy and more layers of insulation to cover up their bungling, and ineptitude. This party can't be called the Tory party anymore, it has become the GORY party. Because everything they touch becomes a horribly messy Gory Hackjob, complete with Hackmen, Hatchetmen, and of course the obligatory Bagmen. Why do we not have a Honest Leadership and Open Government Act. So a political solution to my situation is now 100% impossible with these bunglers in charge.
Digging in the Crony pot of moron candidates to run our most critical systems in our society is not paving the road of the future. JFK did not get living breathing men to the moon with cronyism. Remember what happened with George Bush and Katrina? A society built on making sure only your contractor buddies have any involvement in achieving solutions to the problems of the day, is not a progressive society. Hardly leading edge policies. The road forward to meet the challenges of an increasingly complex society is rooted in leadership that can envelop all people. All persons, regardless of ethnicity, political stripe, gender or how big their brown paper bag contributions are. This is not Baghdad, and we do not want a Halliburton and Blackwater mercenary style right wing society. Creating a society with a increasingly divided, agitated population and large parts of that society feeling alienated and discriminated against is not progressive. Openly mocking, bullying and smugly trashing your political opponents because they want real answers to real time crisis', is not indicative of leadership in any arena. I was stunned when I heard Hector Goudreau say there was no need for a overhaul of the WCB Alberta. How can these elected officials stand up and say they represent our citizens? We don't all dream of having a Upgrader built in our back yard, I'm not mentioning any names here. The worlds most powerful economy is shifting gears on how it produces and consumes energy, it is focusing on new technologies. The new American Administration is focusing on new ideas, they don't want their landscape carpeted with SO2 flares. We can either be part of the solution, or be left behind. Having our politicians go to the US and brag about how frigging great we are is not what they want to hear. They want to here how we are going to help our largest trading partner get out of this economic jamb, and pave a new future. Harper and Ed just don't get it. They try to claim that they created the economic climate during the boom. BS, We live in a energy/mineral based commodity economy and that is why we ride on these boom bust waves. They knew the bust was coming and lied to the population, and now they try to distance themselves from the outcome. Claiming, "how could we have known?" And, "this is worldwide, we didn't cause it." WE need real leaders, with real reform. If we do not get on board with reform, when we wake up on the day the Americans have completed theirs it will be too late. For us to support leaders who think they can do a end-run around American policy is just plain stupid. By the time they are done reforming their government policies and labor standards, if we have not, we are going to be in big trouble. Harper was bragging about the Mulroney Free Trade Agreement. That document will come back to haunt Canada if there is not real reform here.
This is Alberta and if the people in charge can not see the future coming, then those people need to be replaced. I believe that my remedy to my WCB situation is a Constitutional Challenge. Our rights as a group or as a individual injured worker have been stripped from us because we got hurt at work. We are being discriminated against by the act of denying us true legal remedial tort. Talk to any judge, he will tell you that is not a board made up off old bagmen. All other citizens, under all other circumstances may apply to the courts for tort remedy, except us. All we want is too stand in front of a real judge(s), not a tea club of old crony bagman from the WCB. When the Charter was signed there existed on the books laws that are contrary to the Charter. The WCB acts in All provinces are in violation of the Charter. You cannot strip us of the right to seek true legal remedy, the charter guarantees it. To have laws on the books that discriminate and strip individuals or groups of rights guaranteed under the Charter, is in direct conflict with the Charter of Rights and Freedoms. We are all protected equally under the Law.

The validity of the Workers Compensation Act should be challenged on the basis that it infringes the equality rights guaranteed in section 15(1) of the Canadian Charter of Rights and Freedoms (“the Charter”).
In particular to be specific Section 17 is discriminatory, and as such unconstitutional:

Jurisdiction of Board

17(1) Subject to section 13.1, the Board has exclusive jurisdiction to examine, inquire into, hear and determine all matters and questions arising under this Act or the regulations and the action or decision of the Board on such matters and questions is final and conclusive, and is not open to question or review in any court.

(2) No proceedings by or before the Board shall be restrained by injunction, prohibition or other process or proceedings in any court or are removable by certiorari or otherwise into any court, nor shall any action be maintained or brought against the Board, any employee or officer of the Board or any member of the board of directors in respect of any act or decision done or made in the honest belief that it was within the jurisdiction of the Board.

(3) The Board has authority to reconsider any matter that it has dealt with and to rescind or amend any decision or order previously made by it.

(4) Each matter shall be decided on the merits and justice of the case and the Board is not bound to follow any previous decision or ruling of the Board as a precedent in reaching its decisions or making its rulings.

(5) The Board has the same powers as the Court of Queen’s Bench for compelling the attendance of witnesses and of examining them under oath and compelling the production and inspection of books, papers, documents and things.

(6) The Board may cause depositions of witnesses residing in or outside Alberta to be taken before any person appointed by the Board in a manner similar to that prescribed by the Alberta Rules of Court.

I read a article in the Post by a lawyer who deals with WCB claims across the country, secret agent/buddy. A fantasy out of touch rag, if you believe that BS you ARE a moron. The idea of a law firm that advises large employers, while representing injured workers is a old american platform. If you cannot see the trap door in that arrangement, you deserve what ever you get.

Well its official, health care for the Rich is here. Now that the media has jumped all over this, they will have to become much more covert, you know? Like the rest of their government. As I watch developing news on the H1N1 Flu Pandemic, it strikes me how this government has turned a simple public health issue into a boondoggle. At the core of this issue is basic health care needs of human beings, and in particular those persons who are the most in need of that treatment. As injured workers we are used to this style of delivery of medical treatment. I don't think people of Alberta need any more evidence, that Private style health care for Rich people is already here. Stand back now, trough feeders first! Oink Oink. Back of the line you! Trough feeders will even shove pregnant women out of the way. Got to love private pay for health care. Whoever is in charge, go to his house he has probably got lots. This is just ripe for a satirical cartoonist. The trough feeders out beside the barn inoculating each other, while telling the rest of the farm animals there is none left. Oink. Moo. This particular crisis is just a shining example of how the government just doesn't get it. They just can't listen to the needs of the people. They think it is all about them, and their pals. For seriously injured workers the primary need is to treat the medical needs of that individual. Proper medical attention is so critical to a seriously injured worker. What is really going on?

I sure hope that the reason no investigation into gangster type organized crime at the WCB is because the RCMP are involved too. I mean don't you think it is kind of weird that politicians or government officials never get investigated here in this province? I sure hope not. For the sake of injured canadian workers. If so, we are all doomed. I was thinking today that this whole scenario would make a great premise for a video game. I mean the possibilities for different scenarios is infinite. The game could be full of all kinds of super villains, cops, even the army. You could choose from a wide range of machinery and vehicles to drive. There could be negotiators, and just a whole range of wild outcomes. It would be better that the popular game Grand Theft Auto. It is really unfortunate that most people in Canada are too busy just trying to pay the bills to actually get involved in their actually changing their country for the better. Another 2-1/2 years of this government is almost too much to bear. The idea that people would unite, organize and protest the gross mismanagement of this province will never happen, sadly. These people have had their future stolen from them, not just from having to live their lives with disabilities left untreated, which can cause a whole litany of complications as a result. But from not having proper retraining, for occupations that will NOT result in further damage to their already broken bodies. Hostages because of the malicious attack unleashed on them by WCB Alberta, resulting in bankrupt families, families torn to pieces with the survivors left broke, depressed and stigmatized by our government. So as a result these victims are left to their own devices to fend off depression and suicidal tendencies. To be shut out of the opportunities we used to enjoy in society as fully functional, happy contributing members of society is a hell in itself. To be denied proper medical care, medications and medical treatment that could help ease some of our physical, mental suffering is heartbreaking to these victims. The claims managers at the WCB Alberta play mind games with us, torment us, and mock us. They know exactly how critical our medical treatments are to us. They use this to mentally torture us, they know exactly what the effect of denying us medical treatment will do to seriously injured workers. They do this to enrage us, resulting in seriously injured workers being banned from their premises. These people are trained in these tactics. As a result we are marginalized, labeled as crazy, stigmatized as "one of those crazy malinger injured workers". Some of these workers end up homeless as I did. A social worker and my friends advice helped pull me back from the precipice. So you are left completely bankrupt financially, mentally exhausted, and medically untreated injured worker staggering around wondering, "What the Hell went wrong?" To advocate such heinous deliberate willful malicious acts of social terrorism on your society will result in a society that is socially bankrupt. As a result we end up feeling trapped, abused, mentally tortured and not knowing whether or not our government will unleash even harsher penalties on us. We live in fear every day of the government cutting off whatever tiny little stipends that we receive. This government governs by "FEAR". I never used to be afraid of my government. But I am now. For what? Why? Because I got hurt at work? Good men and women are dying in Afghanistan, to protect democracy. You cannot hold up this organization (WCB) as a shining example of democracy, and how democracy treats its own citizens. If the Cowboys in charge will not reign in these rogue cows, then you know what? It is time for a showdown at the OK Corral. Patrick Clayton is Charged & Hector Goudreau stands by WCB Appeals process

I went to the legislature today and visited the gallery on a pass from my MLA. I was shocked and appalled by Hector Goudreau to stand by "Operation Fleece Workers". Many have argued that the WCB is funded by employers. More BS. If workers did not go to work then there would be no WCB. There is no single larger stakeholder in this whole mess than the seriously injured worker. No other participant has as much to lose, and has everything at stake in this process. Not the least of which is his life. I know, I live under the thumb of these "Sieg Heil" bastards every day. Another baloney head waving around the "Appeals Process". B.S., I am calling your hand Hector, because that is what you are doing. You are gambling with my life. And, as we all found out on Thursday. The Shill bastards that glean the very living life and soul from productive working families, didn't like it when the table was turned. Guess what, humans don't like it when somebody else holds all the cards, and their lives hang in the balance now do they? And they are not even disabled. To knowingly target and maliciously strip a disabled human being financially and medically bare, Why? While stripping a disabled human being of all their rights guaranteed under the charter. Then with dutiful malicious intent mentally torture and attempt to inflict a nervous breakdown on another human is a heinous crime against humanity itself. These individuals acting in concert shows collusion and Culpability in a racketeering organization. The malicious maggots who have done this to innocent families should be brought to justice. These documents were faxed to the WCB office downtown. They fed them into their paper shredder. Fair treatment? Working dispute mechanism. Hah! That would assume that the other signatory in this process was not a evil shill bastard hell bent on using any number of dirty, misleading, malicious tricks to roadblock your appeal or any part of the appeal process. Hector, if you stand up for these clowns, your credibility is at stake. Millions are watching you defend very bad people. What kind of legacy is that? I think the good people of Dunvegan and the Peace country elected someone smarter than that. Once again the WCB cleverly downloads the integrity and reputation hit onto someone other than themselves. They do this every day, finding another fall guy is their specialty. Nevermind the fact that your caucus pals have hung a giant boulder on the back of your ski-doo on Sandy Beach. I wonder if they will dive in to save your reputation when it all starts sinking. I have been waiting for my complete file that I authorized for my lawyer 8 months ago. When my claims manager denies a medical need, why does this issue not go before a medical review panel? Rather than a shill unqualified rent-a-doc colluding with sociopath claims managers? Why do I have to go through a needlessly long drawn out shell game run by gangsters, and fraud artists? As a seriously injured worker under extreme physical and mental duress, I simply don't possess the necessary tools to go to court every time I need some medical care. I suppose I should not expect more from those who would mock democracy itself.

Injured Worker Initiated Alberta Stimulus Package

Well if there is one good thing to come out of this, imagine the millions the government is now going to have to spend on security across this province. Funny ED you and your crew claim that the Workers Compensation Board is a independent corporate entity, why is now necessary to beef up security at all your Government offices. Feeling a little insecure are we? That's it ED, further insulate yourself from the population. You know in the old days you guys used to just build a fort. This is really starting to feel like an Oligarchy.Well at least the money the government saved on my care is being spent well.
I am happy to announce on behalf of injured workers everywhere: A injured worker initiated "Stimulus Package". This is exactly what this province needs. Puts lots of people to work. As a bonus, they don't even need retraining. They are security guards. They need even less retraining than a injured Ironworker does. Good job ED. You guys just keep applying ToryNomics. Don't inject a stimulus package into the medical system by actually giving medical care to injured workers. No better yet, let the taxpayers of Alberta pay for my tests and ongoing care for the next 20 years. The total sum burden that has been downloaded onto taxpayers over decades by corporate employers is "Mammoth", incalculable really. You really have to give credit where credit is due. Alberta and the loss of hope

Judging by the Alberta governments response, nothing is going to change. As I expected they are beefing up security across the board at all government buildings. Is the WCB saving employers money yet? Will the guy running this gong show stand up and make the shill bastards that are abusing our hard working citizens accountable, Not! These people are relatives of the government, they are not going to give up their do nothing jobs. They would not be able to rob us blind then. How will they get free financing for their time share projects in B.C.? Will the whistle blowers come forward, not likely. The robber barons are too busy running. Watching all hope fade before your eyes is truly a horrible experience. Any statistics the WCB produces is complete Blarney. Persons from this government open their mouths and B.S. comes out. Moo. Armed man enters WCB Edmonton

The Alberta WCB is just plain bad Karma. And you know what they say about bad Karma, what goes around comes around. Fortunately no one was injured in the standoff. Do I now believe that the Hellberta Government is going to take action and actually make the WCB compensate seriously injured workers? The answer is NO, I do not! We have been lied to before by TORY Corp. Never happen this is a pro-business government and why would a conservative government put and end to what amounts to a hidden TAX on Albertans and Canadians. When the WCB does not pay, the taxpayers across Canada end up paying for the health care and living expenses of seriously injured workers from Alberta. Why are the taxpayers on the hook for my care, and some of it is very expensive. The Alberta WCB obviously has no clue as to what the word "fiduciary" means. More importantly, they do not care either. Who gave these guys an Insurance License anyways. My doctor and all the non WCB health care workers I have encountered in this entire experience have been professional. The only people I have encountered who are 100% non professional, and have not treated me with respect and dignity is the Workers Compensation Board staff, right from day 1. I have been asking for a bed for over 3 1/2 years now. My doctor has prescribed it. If you worked for the WCB what would be the very first item you would buy for a person who fell and broke his back? Good guess, a bed. I sleep on a futon mattress on the floor. I know my government and their pals all sleep on cushy pocket coils. Thanks ED, good job. Now cancel my rent subsidy. Oops, too late Capital Region Housing already did that, who would want to help a disabled person? How is this ending homelessness in Alberta? We now know that Conservative MLA's are impotent against the WCB Alberta, or are they? They are probably given a TORY script. Finally, will seriously injured workers across Canada every get to appear before the Standing Committee on Human Rights, not likely. The (JUST) committee will quickly sweep past us, remember this is a conservative government. Human rights for Canadians, what are you out of your mind. It is funny how seemingly innocuous events are connected. George Bush visits Edmonton to speak to the Oil Elite, and to keep the corporate piracy dream alive. Right wing corporate greed and the worship of money is why the WCB corporate model is so tightly embraced by our Conservative Government here in Canada. The HMO's of America have highly honed this model until it is a true hybrid of the American Corporate Medical Machine. Fully engaging the corporate medical model of America, is what our Alberta Conservative Government is busy implementing right before our eyes. If you cannot see this, you may be living on Mars. The United States of America is busy trying to shake this model, not here, Tories embrace this model. Our government is starving for health dollars, no need to raise taxes or fees to fund it. Just run the system into the ground. When that is completed, roll out the American model. Touting it as the only available option that will save our health care system that the Conservatives are so intent on killing. All this while 900 Million Dollars is being spent on the new "Edmonton Clinic". Well once they have fully mashed the current system, and that of course will include crushing those pesky health care unions that all Tories hate. Then it will be time for their new and improved pay for services system, and with a new Super Board to ensure that those Goddamn poor people don't abuse the system and actually get proper health care. Then our governments true agenda will have been completed. All hail George Bush! Once again the true right wing agenda rears its ugly head. When you are relying on corporate health care, guess what? You're "Denied". When this is all done, the only people who will be able to access top notch medical care are the people who work for the top corporations. Like, Oil companies who pay for the absolute best health care "Supplemental Insurance" for their employees. That's who is going to be getting care at the new Edmonton Clinic. You can watch from the sidewalk. Financed by public funds and administered by Corporations. It is the Alberta Way! The reason this government has no money is because 3 of their contractor friends have to be paid 80 dollars in order for you to be delivered 30 dollars of anything. More corporation, less government. How's that working out for everyone? This government does not care who they have to torture and starve in order to achieve their goals. It makes my sad to know others will suffer as I have suffered.
